Welcome to SparK, a product of SparK LLC. By accessing or using SparK, you agree to be bound by these Terms of Service. Please read them carefully before using the platform.

1. Who Can Use SparK

SparK is designed for use in educational environments. To create an account, you must provide a valid date of birth. Users under the age of 13 are subject to additional requirements under the Children's Online Privacy Protection Act (COPPA) and must receive approval from a verified teacher or educator before accessing the platform.

2. Parental Consent (COPPA)

If you are under 13 years of age, your account will be placed in a pending state until a teacher or authorized educator approves your access. We do not collect personal information from children under 13 without verifiable parental or educator consent. Parents and guardians may contact us at any time to review, update, or request deletion of their child's information.

3. Acceptable Use

You agree to use SparK only for lawful, educational purposes. You may not:

  • Post content that is harmful, abusive, harassing, or inappropriate for a school environment
  • Impersonate another person or misrepresent your identity
  • Attempt to access accounts or data that do not belong to you
  • Use automated tools to create accounts or submit content
  • Share personal contact information with other users

4. Content & Moderation

All content posted on SparK is subject to review by teachers and platform moderators. Content that violates these terms may be removed without notice. Repeated violations may result in account suspension or permanent removal from the platform.

5. Teacher Responsibilities

Teachers who create classrooms on SparK are responsible for managing their classroom environment, approving student accounts, and moderating content posted within their classroom. Teachers agree to use their moderation tools in good faith and report any safety concerns promptly.

6. Intellectual Property

Content you post on SparK remains yours. By posting, you grant SparK LLC a limited license to display and store your content for the purpose of operating the platform. We do not sell or license your content to third parties.

7. Account Termination

We reserve the right to suspend or terminate any account that violates these Terms of Service, poses a safety risk, or is found to be fraudulent. You may request deletion of your account at any time by contacting us.

8. Disclaimers

SparK is provided "as is." While we work hard to maintain a safe and reliable platform, SparK LLC makes no warranties regarding uptime, data retention, or fitness for a particular purpose. We are not liable for content posted by users.

9. Changes to These Terms

We may update these Terms from time to time. Continued use of SparK after changes are posted constitutes acceptance of the updated Terms.
